  • Change jobs soon after second I-140 approved

    Hey guys,

I worked for Company A through which I had an approved I-140 with a date of August 2014. I got laid off in 2017 by Company A and then joined Company B. Company A did not withdraw/revoke the I-140.

Now Company B has filed PERM and is filing I-140. I am however looking to change jobs and am wondering what happens if the I-140 through Company B is approved and I switch jobs within 180 days. Assuming I switch jobs within 180 days after I-140 approval with Company B, will Company B revoking its filed I-140 mess up H-1B extension process?

Or can I keep extending my H-1B based on the original approved I-140? Can the new I-140 null and void the original.

    Thanks!

You can have any number of I140s active at any given time, and all are independent of each other. Whatever happens with the 2nd I140 the 1st one will remain unaffected, and hence can be used for H1 renewal.
Just an opinion; Not legal advice.
