  • Change in Designation

    Hi All,

I have been working in an organization as an individual technical contributor for last 4 years. Last year my organization started the i140 process due to delay process is currently in LCA for a technical responsibilities and this is the first time I am doing hence there is no priority dates. Now I see there exist a high probability to become a technical manager with same roles responsibilities and additional manager responsibilities that includes people reporting to me. I would need an advice if this change would require me to start the i140 process from the start or this process can go with out any issues.

No, you don't need to start i140 process. However, you should consult with your immigration attorney or HR department to confirm whether your new role fits within the same job category and occupation as your current role. If your new role falls under a different job category or occupation, you may need to file a new labor certification and i140 petition.
