I-140 premium processing

Hi,

My labor(PERM) got approved and Employer is applying for I-140. My status on H1-B visa will complete 6 yrs. by Feb-2012. Will I be eligible for I-140 premium processing?

Hi,

Your I140 has to be applied within 180 days from the date of labor approval. So if your labor is already approved, then you are eligible for I140 premium processing. Since, you're H1 is expiring in feb 2012, i would suggest go ahead with a premium processing. It takes around 30 days for approval with an RFE and without an RFE 15 days. Then, you can plan to apply for H1 extension based on the I140 approval.
