    Hello,

    My company recently filed I-140 for me in the EB-1 extraordinary ability. I currently hold an O-1 visa, have over a PhD degree, 15 papers, 800 citations, 5 patents, recos from experts around the world, and close to 3 years of job experience (3 years in 2 weeks).

    However, this petition received an RFE (request for evidence) for information already included in the packet. I have been told that it may be because I filed it with 'premium processing', as the USCIS officers try to buy more time. Can that be true? Any suggestions?

    Hi,

    When an I140 is applied under premium processing, generally comes back with an RFE (99% of the time). But, once the RFE is replied, it takes around 15-20 days for the approval (provided all the RFE documents are submitted properly).
