    Dear All:

    I request expert’s advice on the questions below:

    H-1 6h year Expiry: April 07, 2012
    I-140: Approved under EB2 from company X

    Questions:

    1) What would be new H1B validity if I transfer my H1B to company Y in October 2011?
    (a) April 07, 2012 (Until my current visa 6th year completion date)
    (b) Next 1 year (from the date of transfer)
    (c) Next 2 year (from the date of transfer)
    (d) Next 3 year (from the date of transfer)

    2) Until when my current employer X should keep my approved I-140 active or should not revoke so that my new employer Y can retain my old priority date.
    (a) Until my H1B get transfer to new employer Y
    (b) Until my new employer Y file my labor
    (c) Until my new labor gets approved
    (d) Until my new employer Y file my I-140
    (e) Until my new I-140 gets approved

    3) Can I transfer my H1B to new employer without informing current employer?

    4) I do have photocopy of my labor and I-140 approval but not the originals. Are photocopies are ok for H1B transfer or we need original approvals of labor and I-140?

    Your answers on all the questions above would help me to move forward.
