    Hi,

    I am in H1. My labour and I -140 are already approved. My PD is current ( Jan 2010). Unfortunally my employer got 'Intent to revoke ' of my I -140 from Uscis.

    1) May I know what is the reason for this...?

    I was on unpaid vacation due to my personnal reasons in 2010.so my 2010 w2 was very less compare to my labour certification.

    2)Is this a reason?

    My employer already replied for this query.

    3)what percentage of changes are there to reapprove my case?

    4)Can I file my 485 when my I -140 is pending?

    Only USCIS or your employer can tell what the reason for that is.

    We have no way to know.

    If your I-140 is revoked, you can't file I-485.

      Hi gokul,
      I have the same situation , my I140 was revoked which has a PD of 2008 .
      The reason they asked is wheter my company has paid me prevailing wages and applications filed by my company for labour in 2008 is way more than expected,.
      they did not specifically mention abt 2009 wages,My 2009 current salary is 10k less than prevailing wage.
      Is your issue resolved or still open , please update

        All the I-140 can be approved but the company need to maintain the wages mentioned in the Labor or your company might not filled the taxes to IRS and showed any loss or lower taxes which trigger USCIS that how the company can pay the salaries to the employees when it's not according to the USCIS guide lines.

        Your company might know the reason.
