  • Ray please I need urgent response

Hi Ray, I'm Ife from Nigeria. My dad filed an immigrant petition on my behave when I was still single(unmarried). I got married 20th Dec. 2012 and had a baby Sep
2013. It was just last week here I got a mail from The NVC that my file has been proceeded and a visa appointment has been scheduled in my name.

    My mind bugging question is:

    1. Can my husband and daughter also be a beneficiary on my appointment schedule??

    2. What can I do to make sure my husband and I as well as our daughter get the immigrant visa all together because my husband is hypertensive and he's on a diet and medication which I have been monitoring as he doesn't take just anyhow meal??

    3. What document do we need to tender to this effect??

    4. Or is there anything my dad can do to making sure my husband and my daughter also be part of the beneficiaries??

    Many thanks in anticipation Ray..

Your visa class is presumably a quota-based unmarried child of a U.S. citizen. If you are now married, you are not eligible to use that visa slot without it being modified to "married child of U.S. citizen," which will lengthen your waiting time, by about 4 years.

You were originally F2B class, and your marriage puts you in an F3 class. You need to report your marriage and children to the NVC and have your visa class adjusted (if your dad is a U.S. citizen).

Thanks for the prompt response Ray. Yes my dad is a US citizen. So now, as an expert what do you suggest we should do?? Can I go from the interview all alone and later file for my husband and my daughter when I get to the US?? How long would this take if I wanna go through this process?? Like I said earlier, what do you suggest??

You are not currently eligible for a visa, since your visa class has changed. If you go to the interview and report your current marriage status they will tell you the same thing, that you need to provide copies of your marriage cert and children's birth certs in order to update your petition status.

Your marriage should have been reported to USCIS or the NVC in December of 2012 or thereabouts after you were married.

Of course, I understand you Ray. What I'm saying is that can I still go for the visa interview as F2B and later when I get to the states file for my husband and my daughter??

Please give an advice and steps to take. The petition took a long time initially before I was enlisted for interview.

If you go to the interview as F2B class, get your visa, and use it, you run the risk of your marriage date being compared to when you used the visa, with a resulting visa fraud accusation. Many people do exactly the above, and it later comes back to haunt them when a future visa procedure is started, like Naturalization or petitioning a spouse.

You should get your petition status and class updated. Go to the interview and explain what happened, that you didn't understand that your marriage needed to be reported.

If you try slip past this, it will come back to haunt you when you try to get your husband and child(ren) here.

                      Ray I need help

I live with my husband in Saint Louis missouri, I just file for a I130 petition for him, but i mistakenly put a wrong answer on question 22, instead of putting saint louis missouri as the field office, I put Chicago IL, is that going to be a problem? ??

I expect that it will be changed by USCIS to reflect your area of residence.

I wouldn't lose any sleep over that response.

It might be four more years.
