Out of Status? & H1 approval required at CP?

Hello all:

NVC received my I-140 approval notice on Nov 28. I am expecting CP interview in Chennai in March or April of next year.

My 3 year H1-b expires tomorrow (Dec 1). My lawyer sent the papers to file for an extension to NSC on Nov 22. FedEx receipt says that papers were received on Nov 24.

I have a couple of questions:

1.
Can I continue to work after Dec 1 based on the Fed Ex receipt "proof" or do I need the receipt from NSC ?

2.
If my H1-B extension is not approved before March/April is that a problem for my CP interview which I am expecting by that time.

Please help. Thank You.

answers:

1. Yes you can continue working. You don't need any proof.
2. You should have the extension by the time you go for IV interview. If it doesn't come through, take the recipt of H-1B extension [that it has been received] sent by INS and the attorney certified H-1B extension application sent to INS.
