I-824 and AC-I-140

Hi,
If I want to do AC-I-140(at Mumbai) after I-140 approval without filing I-485 then
do I still need to file I-824 and provide the receipt to be able to co AC CP?

Would appreciate any response.

Hello,

I had sent email to mumbai consulate regarding this.
Mumbai consulate now requires the I824 fee receipt
to process ACI-140 cases. They have also started
rejecting cases where an I824 filing fee receipt
is not included in the packet.

I was told by somebody that now they do not assign a case number unless 824 was included in packet 3. But that for those with case numbers whose packet 3 crossed during this new ruling they are still accepting the case provisional to producing the receipt by the time of the
interview. Is this true ?

If you application is accepted as AC-140 without I-824 then you do not need to provide a I-824 filing at the time of interview. Send a email to the consulate to confirm this for your case #.

What esumeet says is probably true only for November interviews. For December and later there is I think enough time for everybody to get the I-824 receipt. Am I wrong ?
As mentioned, sending a mail would be the best best option.

According to my attorney, cases accepted till Sept 20th don't require I824 receipt irrespective of interview date.

Thanks for the response.
I e-mailed Mumbai Consulate(ins't it [email protected]?) twice and they never responded.
It has been 2 weeks since I sent the second e-mail.
My case was accepted on Sep 22nd. The e-mail sent by Mumbai giving my case number does not mention I-824. I also received packet 3 from Mumbai on Oct 5th without any mention of I-824.

My case is unique since I sent only AC I-140 papers but NOT packet 3. This is to get
a case number and then time the interview so that it will coincide with my trip to India in Feb.

What I fear is that they may ask me to file I-824 when I submit packet 3.

To play it safe, I'd advise apply for I-824. I was accepted on 10/12 and there was not mention of I-824. But, I asked my lawyers to cross-check. Mumbai informed by email that I-824 receipt was required. We applied in the third week of last month and have the receipt now.

Can immihelp or somebody also tell what filing 824 does to your AP and EAD ? I think they get cancelled but was not sure. Or they get cancelled at the time 824 gets approved which is after many months ? If for some reason CP cannot be done (Consulate closes down for a few weeks or something like that) and you have to use AP/EAD will it be a problem if you have filed 824 ? Or worse if you do not get an interview for
several months and your EAD gets cancelled in the meantime ? (Yes, please call me paranoid)

Can you tell how long it took for the 824 receipt.
Also some idea of how long the whole process of filling forms and all that took. Also which service center.

Who has to apply for the I-824. Can you file it or does your employer has to file it?
Basically, who signs at the bottom of the I-824 form?
Can you look at your I-824 filing papers and let me know?

My employers had to sign the 824 - I did not. I got the receipt 15 days after sending the application. It was TSC.
