    is there any limit on how many days/months one is supposed to stay with the employer after you get the Green card. Although I have heard about the new law which has been approved which says that if you have applied for I-485 and it's more than six months you can still leave the employer and continue the process.

    However, my question is after you get green card can you leave within month?. If you leave within couple of months and employer is not happy can he revoke your green card?

    once you get the green card - you can go in and turn in your resignation. that should not be a problem.

      Six Months

      IT is advisable to work for atleast for Six months. That way you are not at Risk. Your Emplyer can try to create problem for you.

      If your Employer Fires you thats a different case.

        it depends how long one has been with the employer. it depends if one has signed any contract with the employer. if you have been with your employer for 2 years or more from the begining, you can leave after the GC. I went to a local INS office and inquire about the similar situation and he's reply was i can change the employer. Read more of this in "after greencard" section. I got the stamp on my passport in September and i've been with another employer since mid October. i had successful CP interview in August.

          ask ins put in writing

          I have found that most the government agency at counter is not good at a little bit compliate case. Ask a written advice from the INS then you are covered.

            I agree - if you can convince an INS officer to put this in writing you will be absolutely safe from any repurcussions. The key is to get this in writing like hello2000 suggested.

              Changing employer after obtaining Green card

              Hey guys be realistic No GOV agency (Last of all the INS) is going to give you anything in writing that will tell you hey "GO AHEAD JUMP SHIP". Even if someone at the desk/over the phone verbally said OK, will that hold up is court.

              Basically the Law does not say you work for that company for EVER. You are expected to work for them however if you find anything else better you can move. The only thing that you may have to prove is that "DID YOU GET THE BALL ROLLING BEFORE YOU GC", " DID YOU LIE UNDER OATH". If the INS filed a suite against you in a court of law can you prove that you had an intension to quit even when you took the oath/GC stamp etc.

              So if you are fine and have this covered you can change jobs. That is where your relation with your current employed comes into play, if you burn bridges and quit they can inform the INS and provide evidence that you Violated the law. If you leave under amicable conditions you are fine.

              So its a personal thing sepcfic to each case i.e. What is your relationship with your current employer, have you signed any contracts etc,etc, also what is the pweriod you feel comfortable you feel obligated to stay.

              So that's all there, Note there is only an interpretation to the Law now black and white line that defines this clause.

              Note " Have you ever heard of the INS grabbing anyone because he quite company X and remove his GC"

              So use some common sense judgment and choose what is best for you.

                Why do you come to this Board ? To soothe your guilt for having leaving the Employer who gave you an access into a great Opportunity (We'll see if it really is great!) So what if the Employer took his ounce of flesh? Were you Blind or Brain-dead when you took the offer? Now you want to change, JUST CHANGE!! I am sure you are not going to hurt anyone! And you won't (apparently) hurt yourself either if you do things the right way. The right way???????????? Do you have the key to the stairway to Heaven! Then give me the key and damn all these issues in life! Who has answeres? And that too in writing!

                OK -- I have vented off! Just listen to Rockstar123 and xKuger and please do not, time and again, return to the same issue! Frustrated guys like myself feel obliged to vent off !!

                    Hi Xcuger,

                    Could you please let me know the kind of "details" mentioned in oath at consulate, regarding joining the same employer after returning to US?

                    In case someone "accepted an offer" before he even got packet 3.

                    Can he still go for CP with old employer, take oath and then after coming back join his old employer and "after one month" join the new one? Is it a right thing to do? Assumption is, old employer is friendly.
                    Please reply. I would appreciate it.
