  • Question for EB3 people

    HI,
    My priority date is 12/99, nowhere near being current.
    But the message on NVC status line says....

    "Your case is current, a packect of forms and instructions will be mailed in 4 to 6 weeks to the attorney on record"

    This message has been there for my case for over a month now.

    I want to know if there are other EB3 CP people, with non current priority date with a similar message on the status line.

    I am pretty sure its a wrong message, but would like to reduce my anxiety a bit.

    My PD is 12/99 and a while ago when i had checked with NVC on the status of my case, it said the same thing that my case was current...bla..bla..bla...so i asked for the operator and she said that a package of I-824 was sent to the lawyer on file but said nothing about the PD's. She said this was just so that you can opt for AOS/CP.

      BTW my PD is 12/99 to had made a mistake earlier (I have edited my original post now.)

      What did you do? Did you receive the I-824?

      In my case, I had ammended the I-140 application to ask for CP, so am not sure if I-824 applies.

        Hi vido,

        I guess we are in the same boat. I am opting for AOS 'cause my lawyer says its safer even if it takes longer. Don't know what to do, where i've waited so long a lil more. What do you say?

          If you opt for AOS on your I-140 and then change to CP, I-824 is REQUIRED !! Your option will be to either file for I-824 and wait for approval, then case moves from INS to NVC and then to your home consulate. If your home consulate accepts Attorney-Certified I-140 (AC-140), then you can file using JUST the I-824 receipt notice.

          With the PDs moving so rapidly and most of people filing AOS (for some unknown fear of CP), the processing time from filing the I-485 to actually getting the GC will go thru' the roof !! Again, even if all dates become current in near future, there is ALWAYS a possiblity of PDs retrogressing and your case getting stuck till PD becomes current again. Remember that ALL THIS TIME, you HAVE to be working for the same employer (or at least the job should be available after you get your GC).

          I was in the same boat but I changed my mind and opted for CP. 4+ months and your temp GC is stamped on your passport. No tensions! No problems !! I would say "CP RULES" !!

            So if you are under EB3 and want to opt for ACP, do you think that is a good option?

              My EB3 date of filing is 25th Jan 99 and now it is current. Shall I apply for CP or I485..??? Iam in dilemma. What is your suggestion. Appriciate your view point at the earliest.
