  • Can we sue the embassy?

    just wondering. I know the consulars have the final say in the cases, but if they mess with someone too much, is that a basis for legal actions?

    I was rejected for a h1b visa under section 2A1, so I am trying to process the waiver. Here are the things that the jakarta embassy has done to me so far:

    1. Giving me the wrong rejection letter when my h1b visa was initially rejected. When I called to verify if it was correct, they kept insisting it was correct. They finally admitted it was wrong when I went to the embassy again to submit the documents for the waiver application.

    2. Withholding information regarding my case. They keep saying they do not know what is going on with my waiver. Even when I asked if simple questions such as "Did my documents arrive at the correct place?", or "where were my documents sent to?", they refuse to tell me anything. Their excuses are inconsistent also, often changing their excuses. I mean, they were the people who MAILED the documents. How can they not have an address or tracking number??

    3. Breaking the set/published protocols. My waiver application was supposed to be sent to the USCIS office in Bangkok, Thailand. I found out 6 weeks later that the documents wee not sent there, but to the US instead. They won't even tell me who they sent the documents to.


    I am annoyed and frustrated with the embassy here. I know they have all the power they want in the world to mess up lives, but this should be stopped. Is there any way we can report this to any authority or sue them? Thanks

    Just the subject line response - NO!

    There are other ways to file complaint against such US governmental agencies.

      USCIS has offices inside the US only. Consulate need not provide any info about your case citing security reasons. Being patient is the only way.

      I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

        You certainly are not being forced to deal with the consulate. If you do not like the way you are treated, go elsewhere. Your attitude is not going to get you any friends there. Have you heard "You can catch more flies with honey than with vinegar"?

              there is a limit to everything, including the unprofessionalism of the embassy officer... i have been playing nice, but I have been treated like dirt... put yourself in my shoes and i dare you to tell me you like getting treated like dirt

              so, where can i lodge a complain against the embassy? thanks

                ... USCIS is directly responsible to the United States Congress.

                So you can send your complaints to:

                Consul General of the said embassy
                The US Ambassador to your country
                Your country's government
                Congress
                Local Senator(s) - if you're in the US right now
                Representing senators
                All the senators of US
                Media - all sorts - CNN, BBC, local US ones

                --- hope you get the idea. If the information is broadcast, usually things change.

                    You are not using your head. Why would you deliberately offend the people you need to help you.

                    If you think you have been mistreated so far, you need to look elsewhere to move. There are far more roadblocks in life in the US than those you have listed and are so angry about. You will not be happy here where SNAFUs and people having a bad day are regular occurances. You need to find a country where people and government agencies are perfect and do everything the way you want.

                      dont hold ur breath

                      my iv case is pending for 2.5 yrs. i have us cit wife n now a baby.my wife approached senator, congressmen. sec of state etc. she had written letters.emails,faxes. they have a proforma on each indivisual senator congressmens website. then they tell u to wait for 2- 4 weeks and call again. finally they say they cant do much with ur case.
                      i have also hired a lawyer .many of them r there to rip u off. be4 being hired they say yes they can expedite the case and once hired the only thing they get done is same paperwork which we can do on our own.
                      even if this processing affects ur family etc u have to go thru this.

                        i remem one senators case worker who was assigned to my case when my wife told her this case has been pending for 2 yrs. she replied "SO"? "there r many people in ur situation".
                        wht these people dont realise is yes it is abnormal if many peoples cases r pending for 2 years.
