  • Abandonment of Permanente Residence

At the time of returning a green card, are any questions asked about IRS or taxes during the appt with the consulate? Thank you.

That is a GREAT question. I work with many clients who abandon their Permanent Residency or renounce their citizenship. They do it for financial reasons, or at least to avoid the expense of preparing United States tax returns.

The consulate does not usually ask you about your tax history. If you are delinquent on your taxes, it will not hold up your abandonment.

That said, they do notify the IRS about your abandonment. If you are lucky enough to be subject to expatriation penalties, you should expect the IRS to come after you.

The easy solution is to just file your tax returns and agree to a payment plan with the IRS.
