J1 waiver- NoRI from home department

To which home department should we apply NORI for J1 waiver. My husband's permanent address is of Delhi and passport was made from Delhi too. However his father, next of kin, stays in Patna . When we called home department Delhi to follow up on our case, we got to know that we will get NORI from Patna. Police verification was already done on our Delhi address and still they say it has to be done from home department Patna coz next of kin stays there
