  • Changing the surname after marraige

    Hi,

I want to update the passport with spouse name (wife) by mentioning the new surname to her name.

In my wife's passport she has before marriage surname. Can I still update my passport with my surname in "spouse name" ?

Is it needed to update my wife passport as well with the new surname ?

    Please suggest.

    Thanks

Are you asking if your (the husband) passport should be changed to reflect your wife's married name?

The only important thing to do is for your wife to amend her passport to her married name, IF HER GREEN CARD AND/OR VISA/ADJUSTMENT PAPERWORK WILL SHOW HER MARRIED NAME. The exception, however, is if your wife prefers to continue using her pre-marital (maiden) name in her legal documents.

If your wife's passport retains her maiden name, the Consulate will be prepared to issue her visa in her maiden name. If your paperwork is in her married name, then you have a problem because the Consulate has to issue the visa in her passport name.

        Do you understand the conflict?

I've had this happen a couple of times, with the paperwork in a married name and the passport in maiden name. The Embassy (Manila) asked the applicant to get passport amended to married name, which delayed everything by about 6 weeks.

On the other hand, if you submitted all paperwork in her maiden name, then you don't have a problem.
