  • PIO/OCI Eligibility for US born minor of former Indian citizen parents

We are currently US citizens in the process of applying for OCI and renouncing our Indian citizenship. Is our child born after we became US citizens eligible for PIO or OCI? If yes, what document should we send as proof of parents Indian origin? We have our Indian passports - but I thought once you become US citizens, those documents are not valid anymore?

    Thanks,

Even though you give up your Indian citizenship, your child is eligible for a PIO card on the condition that you had an Indian Passport at some point in time. If you can get your PIO/CIO card and renounce your Indian citizenship, you can apply for your child's PIO using your PIO as well. Detailed eligibility requirements for minor child's PIO application is provided in BLS website.

-- I don't represent any law firm. I provide my feedback based on my experience with PIO application.
