NEW OCI CARD- Indian parents VISA validity

Hello,

I'm applying OCI card to my new born baby. My H1-B is expired and have approved I-797.I called CKGS and embassy, they were saying YES and NO to submit I-797 copies . is it OK to send I-797 approved copy instead of visa validity copies.

Even I enquired them they told us to go for tourist or entry visa since OCI requires valid visa.
