  • Renounciation of Indian Citizenship Related Question

    Here is the issue guys:

    I became US Citizen back in 2007. I immediately applied for OCI, and I sent my Indian passport for cancellation at that time. I received my passports with "Cancelled" Stamp back in 2007. It DID NOT have "Canceled due to acquiring of foreign citizenship" stamp. I already received OCI card at that time.

    Fast forward to today: We are trying to get OCI for my infant. Apparently Indian passport with "Cancelled" stamp will not be enough per OCI Application. I am guessing I need to apply for renounciation certificate?

    My Question is: Do I pay $250 penalty, even though I CANCELLED my Indian passports immediately after acquiring US citizenship back in 2007 when applying for OCI(There was no renouncation certificate at that time. It came later).

    This is probably gonna put off my plans to go to Indian if I have to pay $250 "penalty" plus additional regular fee for essentially a stamp on a piece of paper called "Renounciation certificate." It just sounds like big money grab by government. We could just use that money for vacation in US or Europe.

    yes that's true if you don't have stamp which says cancelled due to acquiring of foreign citizenship" or no certificate you do need to go through the renunciation process. fee is $45 +250 penalty if passport expired after 2005. but the process has been bit faster now. I applied for tourist visa+renunciation sometime around april 2015 and I got my passport and certificate back under 2 weeks...

      Process might be quick but it still kinda suck to throw $300 down the drain for something I have essentially done back in 2007, but government failed to put "proper stamp" on the passport. Now government wants to retroactively enforce law and collect money.
