I was married to an Indian Software Engineer in 2014 who is working in USA for the past 6 years with H1B Visa status. Marriage was solemnized in India. Soon after 1 week of marriage , he flew back to USA promising that he will send the necessary documents required for my H4 Dependent Visa. Its been 2 years now he neither send the documents nor he returned to India and has already filed for Divorce in USA without any intimation to me. Finally after a long wait, I have filed a DVC case in India against him which is on going.
Now the court has issued Non Bailable warrant against him for violating the court orders and for escaping from Indian law & court.
I am in need of answers for the below queries for which I’ll be most thankful to you if you can provide me with the information needed
1) What is the procedure to be followed for the warrant execution?? To whom and how the warrant to be served in USA?
2) His passport has expired on March 2015. Later he has renewed his passport in USA and the details are unknown to me and the Indian Court. Generally what will be the validity of the new passport when he in on H1B Visa status?
3) Also orders have been passed to impound his passport. But his new passport details are unknown. Is there any chance that the latest passport details can be known using the expired passport details?
4) His H1B visa expires on August 2016 and his green card is under processing. For the extension of VISA does he need to travel India or can be done in USA?
