  • Renunciation penalty - for lost passport by BLS

This is my first posting here. appreciate your help.

We got naturalized on 2013 and applied for OCI/Renunciation in early 2014 with BLS. BLS returned our application after few months during the transfer to COX and Kings and it took an year to get the refund. But in the process, they lost our Indian passports and with BLS, COX and Kings and IC NYC, many attempts to get an answer on our passports did not get any traction and no remediation were provided.
Now we are asked to file OCI selecting the lost passport option for renunciation process. Now we are in to the more than 3 year period after the naturalization and were asked to pay the penalty, which is ridiculous since it is not our mistake that our passports were lost and all the three parties were pointing fingers at each other.

    1. appreciate if anyone has similar experience and any suggestions to go around the penalty?

    2. As per this link - https:///indian-citizenship-renuncia...ificate/#rules - it says there is no penalty if the passport is lost. is it true? When we select lost passport option in renunciation, it is asking for penalty. is it any workaround?

    Thanks in advance
    Hari

first of all, we did not have any passport copies ( scanned and copied to a usb drive, which we lost). As I mentioned that we applied for oci with renunciation in 2014 and BLS returned it without processing and it took so much effort to get BLS refund the money - 2015 was gone chasing the refund and the passports.
