  • OCI and criminal proceedings...

The OCI application asks about criminal proceedings "in any country". I have a single minor US conviction (fine only) from over 20 years ago.

My question is does India do a routine background check into each and every applicants home country before approving the OCI ?

    thanks in advance!

I searched around a bit and found this...

"A full criminal background check will be performed according to the guidelines of the country in which the Indian is currently residing."

maybe better to go with a simple visa rather than trying to get an OCI anyways.

In general the government of India can not obtain criminal history records from US government agencies without obtaining explicit prior permission from the individual involved. See

There are certain exceptions, such as certain sex crimes/serious motor vehicle infractions, etc., which are on the public record. The exact particulars vary state by state. It also likely that US/Indian intelligence agencies share some information about people on terrorist watch lists.
