Indian Citizen.Passport Expired. Consulates in USA not Renewing

    Hello folks...

    Like many,my distant Relative is in USA ,entered years back on Visitor Visa...and somehow still is in USA hardworking and earning a living here in US.
    As it goes,his India Passport expired and The Indian Consulate in USA is NOT RENEWING HIS PASSPORT! only because he does NOT HAVE USA VISA/STATUS???!!!
    Why should Indian Govt DENY its Citizen a Passport simply because they dont have Visa of other Country?

    Is the Consulate Justified? Is it OK to Forsake an Indian National on such Grounds? What should my Relative do to Get his Passport Renewed?

    He is illegal resident in USA as his stay is unauthorized by US government. He will not be eligible to get any official document eg. drivers license or passport. Indian consulate can't encourage someone to stay unauthorized in another country. He will be deported if US government notices his presence by accidental appearance before law enforcement official. He can get Indian passport only in India. There are so many people like him in this country and waiting for amnesty to become legal residents.

      He is a very honest hard worker sustaining his family here and in India...Although he is without US Status,he did not enter illegally.. he is trying to present his Case with the USCIS and get legalized.
      unfortunately his income is bearing a burden of legal fees and his rest of income he sends to India,which benefits a great deal of foreign exchange.
      He NEEDS a Passport which he can present to USCIS which asks for an ID during interview. He wont have one because of such interpretation and he wont be able to put any for the interview, if at all he is entertained by USCIS !!! Anyway India giving its National a Passport is not encouraging any illegal activity...
      If there is a Law that does say so in India......than it can be explained. Even if there were such Law by India...it is inhuman and inconsiderate when India allows so many Foreign Nationals on its own soil on humanitarian grounds...this problem should be addressed by Govt of India...the number of views this Post has generated itself shows the gravity of the insensitivity by the Govt of India.He is otherwise a very honest and exceptionally hard worker...just earning his livelihood...
