    Dear All,
    My Mother is unable to get an OCI. She previously held a PIO. My Father was an
    Indian Citizen. She is a British national, now residing in UK since last 2 Years, prior to this she was resident in India since the mid 1970's. The reason given by the consulate in UK is that now her Spouse (my Father) is deceased. This seems a bit harsh on my 77 year old Mother. Is it possible to get OCI..?
    Kindly advice.

    That seems to comport to the text of the eligibility criteria. That does sound cruel to me

    Why did her PIO lapse? I don't believe it is mandatory that she change it to OCI

      The PIO did not lapse. The new rules state that PIO need to be upgraded to OCI. Is this legally correct, rejecting an OCI application which satisfies OCI eligibility criteria elucidated on the immihelp forum.
      The said person has a PIO, is married to an Indian National and resided in India all her Life. My Father passing away in 2013 seems to have changed the situation.
      Kindly advise.

        Clearly, she isn't married to an Indian National. Sounds to me like her options are naturalization or marrying an person of Indian origin then obtaining OCI on that basis

          Kindly re-read my posts.
          The said person my Mother was married to an Indian National, my Father. My Father passed away in 2013.Both my parents have been resident in India since mid 1970's. My
          Father lived in India until completing his MBBS. He was born in a village in India. We have a huge number of relatives here. My Mother obtained a PIO several years ago.
          The PIO is still valid, a simple PIO to OCI upgradation process is now stalled.
          I am confused about the Legality.

            I read your posts. You seem to be confused between the words "is" and "was"

            Someone who is married to an Indian national is eligible for OCI. Your mother was married to an Indian national

            Since she is an Indian resident, she may well be eligible for naturalization, which might be a much easier step towards ensuring her privilege of remaining resident in India
