Entry visa for US born kid with Indian origin

Hi,

To apply Entry visa for US born Indian origin kid, do we need to have both parents physically present in US?
In our case, one of the parent left to India as Visa expired.
What is the possible options for getting Visa?
Even the notary public refuse to notarize the documents only if both the parent are available in US.
Please suggest your inputs if have come across such situations.

You have a unique situation. I don't have any experience with that. One parent is in India due to visa problems and can't come to the US to get/help with the child's visa. IMO, just apply with what you have. I believe you can get it you try and explain your situation. Did you try? Where did you get stuck? Did you call CKGS? Did you call Indian Cosulate?
