    Hi

    I got my new born baby passport and want to apply for indian visa. I am moving back to India with my family and won't be coming back.

    My wife and I were on B2 visa with 6 months entry and overstayed in US. Will we have any issues while applying for baby visa?

    What type of visa we should go for - tourist or entry visa?

    If you are going to live in India you should get the baby OCI. Nothing less

      Parent's legal stay proof is one of the documents to be submitted for child's OCI. It is going to be challenging to get OCI in USA. Better to apply for Indian visa for the child and apply for OCI from India

        Please let me know what you did? Did you travel to India with Entry visa/OCI/Tourist Visa for kid? I also have to apply OCI/Visa for kid, I am working legally after H1b Expired with receipt notice extension is filed.
