baby with indian visa more than 6months in india

i had sent my one and half old baby(us citizen) to india on visitor visa..now it is more than than 6months and he was not reported in any police station...please guide me , do i have any problems in bringing him back to usa next month..i was told that minors are not required to report if they stay even more than 6months in india...he has visitor visa for 6months for 10yrs..once i go to usa can i report in a police station even after 6months do they pose any problem...please anyone help me and give me some information about this situation..
