  • OCI Eligibility Divorce

Hi - My life is going through some changes. Seeking some clarifications regarding OCI for my soon to be ex-wife and US born children.

current: I am an Indian passport holder with green card.

    Spouse and Children: PIO holders.

We will be getting divorced soon. I know I have to convert the kids to OCI. Even after divorce, my wife will be traveling with us for our India trips. It is an amicable divorce.

    my questions, Post divorce:

    1. I am assuming my wife will not qualify for PIO. Will she be able to get a long term tourist visa or we will have to apply for every trip?

    2. Will the kids become ineligible after my divorce?

    3. If I become an US citizen (OCI holder) will that further change any of these situations?

    appreciate the guidance.

if too complicated, I will engage an attorney for consultation.

    thanks

    Yogi

    1. Yes, your wife should be able to get a multi entry tourist visa (If she is not of Pakistani/Bangaldeshi origin)

    2. Your kids should be eligible for OCI as they are kids of Indian origin parent

    3. No, that won't change anything

Have a question - my brother was married 6 years back and having a 2 yr old US born kid with oci card. He applied for divorce through mutual concern in the court. Now he is planning to travel back to USA this month end based on ticket availability.

What are the implications of divorce(indian marriage) in india for a kid with US passport and OCI card ? Does he need to inform US authorities about his divorce or how does kid's US passport renewal affect him in the long run ?

tiktik Personal events doesn't affect any visa or OCI documents and can be used for travel unless they are officially cancelled by Indian consulate or embassy. In longer run too, personal life events shouldn't affect your kid's eligibility as he is a child of Indian origin parent.
