  • OCI Help - Sought asylum earlier

    Hi,

I have a question about oci application, i will be very thankful if u can help. question is :

Did applicant sought asylum before applying for present citizenship? if yes give specific details when and why

Since my dad applied as asylum, so what should i answer to this question and if we answer yes and provide info, is it gonna be result in any problem for us, or denying the oci.

    Any help is appreciated.

You have to answer yes and provide complete details. Based on that, they will decide whether to give you OCI or not.

If you sought asylum from your country and ran away to the U.S., why do you want to go back there anyway?

      Answer to Immihelp question

If you sought asylum from your country and ran away to the U.S., why do you want to go back there anyway?

I HAVE VERY OLD PARENTS IN INDIA AND I AM THEIR ONLY SON.

I eloped and married a girl against her family. Her family gave me the run and I tried all levels to save my life. At the Police Station, the officer saw my passport and suggested to leave the country with my wife - don't die like NITISH KATARA. I was working for an exporter and the police officer saw my business visas to US/UK/CANADA, etc.

I came to USA with my wife and had our first child after 3 years of marriage and insecurity of life. I qualified for asylum as I had temporary threat to my life back home in India. Today this threat has faded away and my wife family loves to see us and our kids photos.

I had no complaint against the Indian Government. It is the Indian Culture/System which supports such HONOUR KILLINGS. Only 2% of Honour Killings get reported by the media and the rest 98% (most of it in rural India) gets unnoticed.

IF YOU ARE APPLYING OCI FOR YOURSELF THE ANSWER IS "NO".

IF YOUR DAD IS APPLYING OCI FOR HIMSELF THE ANSWER WILL BE "YES". BUT YOUR DAD MAY NOT QUALIFY FOR OCI AND CAN APPLY FOR ENTRY VISA.

          oci help- sought asylum earlier

i wanna say thanks to mr. nitish katara for answering my question. thanks so much. so if i apply for oci myself, you think it wont be a problem. because on my indian passport it has a stamp on it saying asylum granted. and when we apply for oci they gonna be asking for copies of indian passports. so since it says on my passport. that makes me an asylee too. i dont wanna be accused of lying and then get denied. any suggestion.

            Yes & no

Since the question was about the father applied asylum; the answer related to that question.

If you have a stamp on your Indian passport; it means that you also applied for asylum. Hence you should not lie in the application but give the exact facts of your asylum.

Asylees do not qualify for OCI/PIO and hence I would suggest to apply for Entry Visa. You will have to personally visit your Indian consulate to confirm.

If you were not 18 years of age when your father applied for asylum; then technically you did not apply for asylum. Please confirm with your consulate and it will depend on your facts/documents.

            Best Wishes.
