Damaged Indian Passport with expired Visa, valid i94

My Indian passport is damaged, US visa in the passport is expired but the I94 is valid.
i have sent the passport for renewal with the i94 attached. Its been 3 months and houston consulate is not responding!!!
They say they can't process the application when the visa has expired. Is this a valid statement?
What do I do? I also need my I94 back at the earliest since I need to file for a I94 replacement for a damaged one....

Expired passport and visa

Hi,

Have you heard anything from Indian consulate. My daughter has similar issue, her visa has expired but she has valid I-94. I am planning to go to Chicago consulate in next week.
