My 11 yr old daughter is foreign citizen by birth and staying in India with me and PIO card holder which is valid for 13 more years .Her passport is going to expire in few months.I am unable to renew it as my husband does not want to cooperate.Is her stay legal in India or there may be any legal problems?Can't we wait forfew more years as she will not require her parents presence to renew her passport after few yrs.pls help.I am very tensed and suffering from ailments due to this tension..

You need to apply at the consulate of the country your daughter is citizen of.
If they refuse to renew her passport only with one parent's consent, you must work out the situation with your spouse, one way or another. It seems your relationship with your spouse is not going well and you are probably in the hold mode, such as neither divorce nor staying together happily.Immihelp Support

I think you are right and we should go the right way and face the situation.I will definetely consult the Consulate for my childs passport and resolve the situation out.That would be good for my childs future too.I was just tensed so posted the question this way.Thanks for the reply..

Hi, I am not aware of this kind of situation but was thinking. Why should there be legal problems to stay in India? There is a mention of some people's experiences on this link I have attached for your reference, please go thru it.
My thoughts are :
If the child has a PIO, no need to register till age 16.
If the child just has a visa, he/she must first get a registration and then a PIO card.
I think in India, if we ask Police or Govt officials, some of them dont have complete information and they just show their power.
We should do complete research and approach them.
Please let us know your experience and it is good that some people come back and post their responses.
I dont think there is a reason for you to worry. Its ok for minors to stay in India. So many foreign born children are in India, especially when parents have to travel to jobs abroad, give birth there and come back to India once project is over.
