    Hi All,

    I had been into a marital relationship for over 5 years and had been staying in USA with my husband on H4 visa. We had an arranged Hindu marriage but right from the day one of our marriage, we had been having problems for which he always blamed me for the things that never existed. He would never speak to my family but would call them and complain about me over small issues like making of a curry, going to gym etc. And in that whole process his family would support him.I was mentally tormented even more when my in-laws visited me and they would use abusive languages against me and my family. So I wanted to visit my family back in India to have mental peace and change of place( since I hadn't been with my family at all after my marriage as he would always insist me to stay with his family all the time).

    Just recently, we both came to India for stamping and then were staying at my in-laws place when he again started using slangs. So I could take it no more and went to my parents place to have mental rest.We both were supposed to return back in a month but inspite of repeated calls and contacts from our side, my husband didnt turn up and returned back to USA without intimating me. I had actually left all my travel documents at my in-laws place. So now I am unable to get back my documents since my in-laws( they are not to be found at their home) and husband are in no way responding back to me and the visa expiry date is drawing nearer. I do not have any single copy of my documents.

    My question is:

    1) How can I get back my documents in such a case?

    2) Can I travel back to US without travel documents but with a valid stamping on the passport? Can I get another stamping done without the documents for the purpose of travel?

    3) I am not sure whether my husband wants to file for divorce or not. But if he wants to do so, can he file from the US?

    4) Can anybody, please advise, what are the rights for me as a dependent legally in terms of protection?

    5) Will the US Embassy be of any help in this regard?

    I would really appreciate any immediate help. Please, please do reply.

    1. Depends on what route you want to take. They holding your passport is illegal.

    3. It is not so easy as the other party has to be notified.

    4. I think you are over reacting. Let the emotional highs cool off and the dust settle down. Be patient and try to reconcile.

            No, consulate will not come into this as it is a civil issue.
