Passport name changed. Now SSN dilemma.

  • Passport name changed. Now SSN dilemma.

    My wife's last name and my last name are different. She did not want to keep my last name as her last name because its my father's first name. My first name cannot be pronounced by any non-indian person and so we decided that all of us, including our kids will have our great-grandfather's last name - Rao.

    So, my wife did all the particulars and got her last name changed to Rao. She even got a new Indian passport with last name as Rao. But when we went to SSN office, the guy said that they need something from USCIS that proves her last name is Rao. So, the next time our AP and EAD got renewed, the attorneys got the new passport and all her new documents renewed as Rao as the last name.

    Back to SSN office we go and the guy refuses to accept the application because he says it has to be legally approved by court. I have no idea what court order. We are not green card holders and only have EAD/AP with I-485 pending. Please advice how she can get SSN with new last name and Drivers license.

    On the other hand, I am sort of sure we will still be able to travel back and forth from India since we have AP and passport with new last name. If there is going to be a problem, please advice on that as well.

    There's no real problem, except that her SSN record won't reflect the most recent name change. This could cause some hiccups when either of you retires or claims SS benefits, but no real problem.

    When travelling with her passport, if your wife's passport name differs from U.S. entry documents (visa, etc.), she should have secondary civil documents which show the name change. A local court name change is fairly easy to accomplish in the States, though the fees and rules vary by state. But the subsequent court approval may come in useful in the future.

      OK. Thanks for the information. I will contact one of the local courts in San jose and enquire.

        The fee for a name change petition in San Jose (Santa Clara County) is $435.
