I filed my labor cert on March 2003 and until now still haven't heard from DOL. My main concern here is...currently I don't have 245(i). I came to this country legally as a fiance k2 dpendant. I have I-485 denied since I'm out status already. My questions is when my labor cert approved do I need to apply for 245i? or 245i can be replace by I-485?
Case #2. As you already know, I came legally w/ visa of fiance k2 dependant. I came here when I was 20 years old six months before turning 21. My mom married within the 90 days and we both filed our papers I-485/786 4 mos before turning 21. I got denied that time because I'm out of status. Now, we have this new law "CHILD STATUS PROTECTION ACT" basically, it will prevent from the child who are "aging out". I'm married now and not sure if this still applicable to my case. Is the CSPA can do any good to me even I'm married now? I was single back then when the CSPA was approved. Can I claim my status during that time? How about if I become single again, does this applicable to me? I been talking to different lawyer about my case but there response is unsure. I am desperately in need help here and I'll appreciate any help you can provide. Thanks in advance.
