Hello,
I'm an tenure-track assistant professor in University A. My H-1B status expired in August 2015, and I got an H-1B extension from September 2015 to August 2018.
Question 1: If i get a new job offer from University B, will it be as simple as switching my H-1B extension from University A to University B? How much will this cost University B and how long will it take?
Also, I just started talking to University A about changing my status from H-1B to residency. We are aiming to begin this process in Fall 2016. (This is assuming that I do not get the job in University B.)
Question 2: If University A starts the process for me to get a green card in Fall 2016, do I have enough time since my H-1B extension ends in August 2018? I do not qualify for the EB-1 process, so it will have to be through the EB-2 PERM process as a University Professor. (I am citizen of a South American country that is not Brazil, Venezuela, Colombia, or Argentina.)
Question 3: I think University A did not file for my Labor Certification. How will the answer for Question 2 change if University A did not file for my Labor Certification within 18 months of hiring me?
If I get offered a job as a tenure-track assistant professor by University B, I will only be able to work for them from September 2016 to August 2018 under my current H-1B status.
Question 4: Is this enough time for University B to process my change my of status from H-1B to resident also through the EB-2 PERM process as a University Professor?
Other information: University A is my first full-time job after I got my PhD; both universities are relatively small, University A is private and University B is public; I definitely won't quality for the EB-1 process
Thank you in advance for your advise.
