45 day letter - case closed

Hello All,

I received a letter from BEC stating that my was closed due to untimely or incomplete response to the 45-day letter that was sent out. Now, neither me nor my employer or my attorney ever receive the 45-day letter. My lawyer has filed a motion to reopen and that was 2 months ago (in december). I want to know if there are cases similar to mine out there and if yes, what action have you/your lawyer have taken to re-open the case? Were any of the cases re-opened? I am also under a time crunch since my H1B expires this September (six years will be complete on my H1B). Even if i apply in PERM i won't meet the 365 day pending application criteria to extend my H1. Is there any other way that my H1 can be extended? Thanks in advance.

Your only solution is to file online permanent which takes only 90 days to be approved. Go ahead and have your employer to setup an online account right away, since it takes a few weeks to send the pass and PIN to access the account online...That's your only solution...
