    I am a well educated, seasoned software professional working in USA for the last 1.5 years on H1-B. Now I have received job offer in a start-up software company in managerial cadre. During the discussion, I was told that I could apply for I-485 straight away (with out PERM labour approval and I-140 approval). Is that correct? Or have I go thru the normal process of applying for PERM, then I-140, etc? Another point. Is salary going to be a criteria? In the new organization, I have been offered minimal base salary for survival and then the profit is shared. The new company has been incorporated some years back but did not function. All I mean is that they dont have any profits to show in records.

    First of all, you cannot apply for 485 even if you are a nobel prize winner. And yes, salary is definitely a criteria. Visit the DOL website which lists minimum possible salary for your position.

      1. You can't apply for I-485 without PERM labour approval and I-140
      approval.
