    Priority date retention

    Hello Gurus -

Now that priority date has moved to June 2006, I am wondering if I can retain my priority date from my last employer.

    My current scenario-

My PERM hasn't been filed as yet but my employer/company lawyer intend to file it by end of this year.

I have approved PERM and I-140 with Priority date of Feb 2006 from my ex-employer.

    My question-
Once my PERM is approved, will I still be able to retain my PD? Will my PD be treated as current? and will I be able to file i-485 concurrently?

    Thanks in advance.

    Yea, Yes and Yes.

I am not a lawyer and you need to consult with one to validate any info posted on the forum and discuss your case specifics. H1b Question? Read the FAQ first.

This is great news. I didnt know that. But, who will file this, and are you in the same location to get this done?

My current company will file all the paperwork and I am in the same state.
