  • Labor Processing Time

    Hi All,

    My labor was filed on April 10, 2008. My understanding was that labor processing should be done within 3 months. My case has been pending since last 6 months and my attorney is saying that he does not have any status updated from DOL.

    Is this happening to everyone who filled labor in early 2008? I am just worried if only my case is pending.

    I heard from several of my friends that the PERM is getting delayed these days. Its been past 3 months that my labor has been filed in Atlanta and no luck yet. Counting on it. A friend of mine got it after 8 konths and another 10 months. So, don't worry yet. These desi consultants also play games many times by not relvealing the approval notice. We have no option other than trusting them. Best of luck!

      My labor was filed on July 2008. I have few doubts
      1. what is the current labor clearing dates..
      2. Approximately how long will it take .
      3. Is there any difference for EB2 or EB3 labor?

        1. Such a thing does not exist.
        2. No one can tell. 6-12 months.
        3. Not in terms of time for labor to be processed. EB2 approval is tough when compared to EB3. A ton of difference as these are two different categories.

          I don't think in the present situation you will be lucky enough to get your LC in 12 months also. Mine was filed on 1/31/2008 no information.. Of course if you are very lucky you will get the status asap.

            My labor filed EB2 in Jun 2008 audit in August.
            no update yet.Lawyer says 15 months....................

              My labor filed on 26 June 2008, under EB2
              No audit; No update
              No idea when it will approved

                Hi friends,

                My PERM was approved on 4/13/2009.
                Filed: 8/4/2008
                Audit: No

                It is easy to tell you to be patient, but since I practiced it for the past few months, I can recommend that to you too.

                    Did everyone who posted on this thread with PD in 2008 get their labor approvals? My filing was in June 2008 and havent heard anything from DOL yet!!

                      My application for Labor Certificate was filed today! I'm guessing it takes about a year? How common is to get audited? Fingers crossed...

                        My PERM (EB2) filed on OCT 15 2009 from DC, and my lawyer says it will take some 7-8 months, if there is NO audit. If there is audit add 2-3 more months. But it was also said, Perm filed in 2009 (after June) will take less than 10 months.

                          Processing time

                          Hi,

                          Just share with you guys my whole application process for your reference :

                          -filed LC in Jun 2008, got approved in Feb 2009
                          -filed both I-140 + I-485 in early Apr 2009,
                          -received EAP & AP in the late April 2009
                          -did fingerprint in late Apr 2009
                          -I-140 got approved in early July, 2009; I-485 got approved in late July, 2009
                          -received my Green Card in a week after I-485 got approved

                          The whole process of my G-C application only took less than 1.5 yrs. I filed under EB2. I think that there are couple of crucial factors that made my application so smooth and fast. (1) I came from the country with quota available. (2) My attorney and my HR dept responded quickly and followed through to USCIS' instructions & requirements. (3) My HR dept has previous experiences of G-C sponsorship


                          Don't get frustrated. Be patient! I hope all of you could get your G-C soon.

                            perm Processing time

                            Data released by DOL as of end Oct'2009 - shows they are reviewing petitions applied in Jan'2009.
                            On cases that went on audit its a 2 year wait on an average.
                            Since there were very less petitions filed in the 2009 period, I am hopeful that the DOL catches up soon, but thats all an iffy situation.
                            For now its close to 10 months wait for cases that havent gone for an audit.
