What happens if a software engineer has a degree in Mechanical Engineering (MS) with 6 years of software experience and the employer files for GC with the details of minimum qualification for the candidate's position as BS in CS/EE with 4-7 years.The company has a uniform policy of filing in this way and will not change the minimum requirement to BS in CS/EE or equivalent. How will the DOL interpret this ? Will this be in EB2 or EB3 or will the DOL reject the application because of the change in the branch of engineering?
