  • Perm Processing

    Folks,

I have a question regarding the perm processing.I am in the sixth year of my H1b.My company is in the process of filing my PERM.
What is the latest i can get an extension of my H1b for my seventh year.
If there is delay, what is the other alternative.

    Thanks in advance....

If you are already in the sixth year and your PERM has not beed filed yet, the only option is to get the PERM approved ASAP and apply for I-140 with premium processing (check eligilibity based on new rule on PP I-140). Once the I-140 is approved, apply for H1 extension. Any time spent outside the U.S. including vacation can be recaptured to meet the 365 day PERM period. Please provide details for best options.
