    Hi,

    I am thinking of filing my GC with my current employer. I have 5 years and 9 months of IT experience till date. Before joining the current employer, I had 4 years and 9 months of experience. Can my employer file my GC in EB-2 category? In other words, since I have more than 5.5 years experience can my current employer consider it for filing EB-2?

    If not, what are my other options. If I switch my job, can I ask the new employer to file it under EB-2 since I would be having almost 6 years of experience then.

    Also, My H1-B is going to expire in Apr-2011. How soon should I file for my GC?

    Please guide me as this question is important for my career.

    EB2 or EB3 is determined by what the job requirements are. Not by what you have.

      Thanks for the reply. You can apply for EB-2 with Bachelor degree + 5 years of experience and hence I wanted to know if I am eligible. Can you elaborate your reply please.

        The job should require a BS + 5 years experience first. Then it should advertise the job and not find any USCs/GCs that suit that experience. Then what you have comes into picture.

        You need 5 years of progressive experience and the current job experience cannot be used unless the GC position is atleast 50% different from the current job that you hold.
