Recapture Time on H1b

Hello folks,
I have a question regarding my PERM

My perm was filed on 03/05/09.
Expiration of my H1b is on 02/28/09 on my I-797
Visa Expired.

My employer is suggesting me to travel to canada for a vacation to recapture my time.
Will be it problem for me to flyback from canada.

Since my visa has already expired and my plans are not to get my visa stamped.
When come back after a week, all i would have is my valid I-797 papers.

Do you think i would have a problem at the port of entry at the airport.

You would need a valid visa to enter. The contiguous territory rule may work but I would not risk it.
