Hi All,
I am one of those unfortunate guys whose PERM was applied in third quarter of 2007(My PD is in NOv'07), got audited and I am still waiting after 700 days.
My H1B is valid till Feb'10. My employer is saying that he will apply for extention from some other company as there are many RFEs for extentions that he filed in recent times.
I believe that this makes my case a "H1 transfer" instead of "H1 extention."
Now my question is, If my PERM gets approved do I have to forgo my PD or is there way so that I can still use that PERM.
