    Hello everyone, need your help baldly. I just spoke with my company attorney they said due to COVID-19 they haven't even posted the job recruitment yet. Assuming that my L1 visa is denied will this step still continue even if i move back to India. Will they still file my Form 8089 from India ? Or will this be scrapped and i need to start only when i am back to US ?

    Yes, Green card is for a future job.
    So they can file perm, get it approved followed by I-140

      So you mean to say even if they havent started PERM job advertisement step, i can see the process continue from India ? Assuming still i am with the same employer

        This is the same question you asked previously, and the answer is YES.
        GC is for a future job, so all steps (PERM, I140, I485) can be done without you being in the US.
        Just remember that when you get to the I-485 stage (could take a few years), the company needs to provide an offer letter that clearly has the salary, job title and description as stated on the PERM application.
