Promotion and Job Responsibility Change

Hi,

I am currently working as Financial Consultant on H1-B. I received PERM approval last month for EB2. My company is in the process to file I-140. I am being offered a promotion to Finance Sr. Consultant in a different group within same company which will give me about 8%-10% rise in salary. Some of the job responsibilities vary from my current position mainly due to higher level and different department. Does my situation warrant a new labor certification?

My opinion, I would think it is outrageous to assume that the GC candidate is going to remain in the same position in the 5-15 years (assuming India) while this person waits for his GC.

Anyways, you can move around, take different jobs while you wait for GC. The rule is when you do the get the GC (or when you file for I-485 to be safe), you need to assume the responsibilities outlined in your PERM. So I say go ahead.
