Need info to change form EB3 to EB2

Hi,

I applied for gc in jan 2008 in the EB3 category.
My labor and i140 got approved. I got promotion this year(2010) i would like to move my GC to EB2 category.

Could anyone plz explain me the process involved? also any idea how long will it take for my labor approval?

Most likely you will not be able to Do so....

EB2 / EB3 is based on a Job requirment in the the Future..... In between the process you cannot change the original Job requirment of the future. if you do the original filing becomes invalid/nullified and the process has to begin again.


Also it does not matter if you recieve a promotion or a double PHd, you simply me over qualified for the jobs thats all.
