    Hello

    Is there anybody in similar situation...
    I applied for my LC in summer as a teacher and I have received a Notice of Findings.
    The reason: not sufficient recruitment effort, looks like the DOL needs the employer to advertise in a PAPER professional journal.
    The employer used only online ads ( professional journals and the college website).
    To rebut, employer must furnish a copy of at least one print ad. published (PAPER) professional journal. Can this be avoided, by submitting other documents. New job ads and the hiring process again after a year ...

    I think DOL (Federal level) wanted you put one more add in new or professional magazine in your work area to see if there were enough qualify candidate for this job or not.

    There was no way to avoid or to skip this step (Since economic situation now is endless of laid off). Otherwise DOL would not approve your LC petition. To reject the qualify candidate for this job, you need very careful documented the rejection reasons, them you need to submit your reasons with candidate resume who applied this job to DOL (Federal level).

    I did not know what kind of teach you were, And what kind of ad you had put in advertisement before you applied your LC.

    Here were some of lawful reason: The applicant for this job was H1-B, B1/B2 or applicant had not legal status in US. Remember you can not stick your job qualification reason like: The candidate applied this job need to speak Chinese or Indu language.
