  • Difficult situation regarding SCHENGEN VISA.

    Hello.
    I have a question about the Schengen Visa. I have been to Germany on 16 JUNE 2012 and I stayed there for 30 days. That means I have used 30 days from 90 days of my staying quota. That means I have another quota of 60 days.

    The 6 MONTHS PERIOD from the first date I entered Germany, which is on 16 JUNE 2012 ENDS on 16 DECEMBER 2012.

    And here comes the hard part.

    If I went back to Germany on 10 NOVEMBER 2012, am I allowed to stay there until 16 DECEMBER 2012 and CONTINUE for 90 days more since I have a NEW 90 DAYS QUOTA since the NEW 6 MONTHS PERIOD starts on 17 DECEMBER 2012?

    OR I need to exit Germany EVENTHOUGH I have the 90 days quota in the NEW period?

    OR is it a MUST to exit Germany for a certain period of time before re-entering again, EVENTHOUGH the NEW 6 MONTHS PERIOD already started?

    Can anybody understand my situation?

    You will NOT get 150 days. The 90 day stay is in every 6 month ROLLING window, so it's not fixed to your last trip. If you come now, though, you will likely be allowed to stay another 90 days. But, you sound Indonesian, so I assume you either have a multiple entry, long term business visa, or you are going to apply for a visa. If you're going to apply, ask them if you can. i'm sure it will be the case.

      No no. The question is, the 6 months period since my last entry will end on 16 December. Therefore on 17 December 2012, I wont be given the 90 days quota again?

      And another question. Is there by any chance that I need to go out of Germany for a certain period when the last 6 month period ends even I didnt use all 90 days for my last visit?

        You can never stay for more than 90 days on any one trip, so if you enter in November, the maximum number of days you can stay is 90. On this second trip, the "six month" period now includes this trip. It is not fixed to the beginning of the old trip, hence it is a ROLLING period. It always follows you. However, they hardly enforce the period, and you are generally allowed 90 days in the Schengen zone unless you travel VERY frequently and spend a lot of time here, which might make you suspicious to the border agents.

        Do you have a visa? What visa is it? If you have a long term visa, then you can stay for 90 more days. You won't get in trouble. If you don't need a visa, again, you can stay for 90 days.

            No problem. Yeah, you sound Malaysian, too. And Bruneian. But, since you mentioned a Schengen VISA, I figured you were Indonesian. But, anyway, don't plan on staying for more than 90 days on the trip. If anything, you can leave in the middle (to the UK, or Romania, or something) and re-enter, but they can easily refuse to let you stay for another 90 days.
