Transit visa - germany

Hi,

I have a query regarding the German transit visa.I would be much obliged if i get a quick response to this mail as i have to act fast on this.

This is my situation.

1) I came to the US on a L1 visa expiring on April 3 rd 2006 with an I-94 till Dec 2007.
2) My visa got converted to H1b while i was in the US and my new I-94 is till Sep 2008.
3) I am now going back to India for good .
4) I have an air india flight itenary for 15th April(after my L1 visa on passport expires) via frankfurt.
5) My question is do i need a transit visa for my travel back to India via germany.
6) I checked with the german consullate and they told me that if i am returning to my country i do not need a
transit visa.

But i get different notions about the same.

Please help me in this regard.
