I had H1B stamped in 2012 with my previous employer but never used, am I eligible for cap exempt?

also, I do not have copy of i797 will I be able to request duplicate copy from USCIS?

I-797's top portion has validity of one year and I-94 has 3 years validity. My attorney says that its valid for 3 years but i am not 100% sure that it is. we raise the concern to USCIS with it but USCIS is not providing any feedback on the case.
